‘White Category’ Industries Could Be Exempt from Environmental Permits
On 19th July, 2024, the Ministry of Environment, Forest and Climate Change issued draft notifications that could exempt 'white category' industries from obtaining prior permissions under the Air Act, 1981, and the Water Act, 1974.
Proposed Exemptions
- Exemption from Permits: The draft notifications suggest that 'white category' industries, which are considered non-polluting, may not require prior 'consent to establish' (CTE) and 'consent to operate' (CTO) permits from State Pollution Control Boards.
- Merging CTE with Environmental Clearance: For projects that require prior environmental clearance (EC), the CTE permit could be replaced by merging CTE compliance conditions with EC conditions.
