Supreme Court’s Observation on SC & ST Act, 1989
On 17th May, 2024, the Supreme Court (SC), while deciding a case arising out of a complaint made for an offence under the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989 (SC & ST Act), observed that an allegation of insult has to satisfy the requirement of having been made within public view.
What are the Observations made by SC?
- Insult in Public Place: Intentional insult must be made in a place within public view in order to attract provisions under Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989.
