Constitutional Validity of Section 354(5) of CrPC, 1973

On 21st March, 2023, the Supreme Court asked the Centre to defend the execution law under Section 354(5) of the Code of Criminal Procedure (CrPC), 1973.

About the Section 354(5) of CrPC, 1973

  • It provides that when a person is sentenced to death, the sentence shall be executed by hanging by neck till he is dead.
