Power of Arrest under Section 41A of the CrPC

Recently, the Bombay High Court, while hearing the case of the arrest of former ICICI Bank CEO by the Central Bureau of Investigation (CBI), termed the Section 41A of the Criminal Procedure Code (CrPC), 1973, as ‘Abuse of Power’.

  • The High Court said that the arrest was not on the basis of any additional material discovered during the course of investigation, but the same material within the knowledge of the investigating officer when they were issued notices under Section 41A of the CrPC.
